He created the “Source Rule”, which is widely credited as a primary legal foundation for the contemporary hemp market in cannabinoids and other cannabis materials. Rod represents legal cannabis businesses throughout the world, is editor and chief writer of the Kight On Cannabis law blog (www.kightoncannabis.com), and is the author of “Cannabis Business Law-What You Need to Know”, published by Aspatore Books. Rod has served on the advisory board for the American Journal of Endocannabinoid Medicine (AJEM), for which he wrote a legal column. He also served on the board of directors for an international cannabis and psychedelics company.
Rod is frequently quoted on cannabis matters by trade publications and major media outlets including the Wall Street Journal, NPR, Time, Washington Post, Forbes, Politico, Salon.com, and Business Insider. He has been part of the legal teams in several high-profile cases against the DEA and various states regarding hemp, has drafted and presented cannabis legislation to a foreign head of state, testified to the FDA about CBD and cannabis compounds, has served as an expert witness in cases involving hemp, and co-founded a Mexican import-export company focused on legal cross-border hemp transactions. Rod routinely advises in-house counsel and C-suite level executives on cannabis matters and has discussed cannabis legal issues in numerous conferences and seminars to lawyers, business executives, and public officials. Rod is regularly asked to be a guest speaker on US and international podcasts about cannabis and psychedelics.
Rod is a strong believer in cannabis for personal and medical use after using it successfully during chemotherapy treatments for cancer (he is in remission). He has been an attorney advocate for NORML and has also been a member of the International Cannabis Bar Association, the National Cannabis Industry Association, the Hemp Industries Association, the Southeast Hemp Association, and the US Hemp Authority.

Since 1985, he has handled cases across criminal law, complex civil litigation, international war crimes, and, most notably, hemp and cannabis law. As a strategist and courtroom advocate, David brings both vision and grit to the legal battles that define the industry.
His passion for hemp law is personal—after seeing firsthand how the plant helped both of his children and several close friends, he committed himself to protecting access and fighting for sensible regulation. That passion now drives his leadership at THCA, where he serves as the group's big-picture thinker, legal architect, and lead litigator. He played a central role in several landmark cases, including the Sky Marketing case in Texas, POB Ventures v. FDACS in Florida, and H.I.L.T. v. City of Allen and DEA. In addition to his courtroom victories, he has successfully settled multiple lawsuits related to unlawful raids on hemp businesses, ensuring his clients received just compensation for seized products, wrongful arrests, and damage to their reputations. David has also been active in Texas legislative efforts, working with lobbying teams during the 2023 and 2025 sessions to oppose restrictive hemp legislation like SB3 and HB28.

A stalwart free speech defender, he’s been on the forefront of headline constitutional battles from the COVID vaccine debate to cannabis legalization to challenging civil and criminal RICO statutes for his entire career. Effectively navigating crises, David has staunchly defended against censorship, even embracing unpopular messages to help protect the rights that matter most to Americans. As a successful and passionate advocate for marijuana legalization, David has been on the frontline of the debate and is one of the longest serving counsel in New York state on the subject. He has been a prime mover as a member of several think tank organizations focused on cannabis legalization and was instrumental in obtaining six presidential acts of clemency from both President Obama and Trump for elderly prisoners serving life sentences without parole for cannabis offenses. Today, David left his position as a Partner at the Prince Lobel Tye LLP law firm and has formed the business and general litigation firm of Holland Schriever LLP where he represents a wide array of clients across a number of disciplines. He is also the Executive and Legal Director of Empire State NORML (the New York State affiliate of the National Organization for Reform of Marijuana Laws), Co-Chair of the NORML Amicus Committee, Co-Founder and President of the New York City Cannabis Industry Association as well as a pro bono Legal Advisor to Last Prisoner Project (LPP). David spent a dozen years serving as Of Counsel to the late Michael Kennedy, Esq., an outspoken criminal defense and civil rights advocate as well as providing counsel to High Times Magazine. In those roles he challenged the constitutionality of federal cannabis laws in several legal actions and defended those using marijuana for medical purposes including the precedent setting case of Scott Martin v. The City of Buffalo attacking an outdated collective bargaining agreement and drug testing policy and causing the restoration of position, back pay, and all benefits stripped from this armed services veteran.
David is admitted to the Federal and State courts in New Jersey, New York, and Maryland, as well as the U.S. Supreme Court and the 2nd Circuit Court of Appeals. His Juris Doctorate degree is from New York Law School.

Andrew believes good lawyers are those who chart the most efficient path to the most effective legal solution to reach the client’s personal or business objectives. Andrew is also committed to his community. He is past-president of the Westchester County Bar Association and the Legal Aid Society of Westchester County. Andrew is also past-president and co-founder of the Hudson Valley Cannabis Industry Association and a co-founder of the New York City Cannabis Industry Association, groups that were instrumental in helping shape the cannabis policy discussion when New York implemented its legal adult-use cannabis market. Before becoming president of the Westchester County Bar, Andrew served as its vice-president and treasurer. He also founded its Attorney Wellness Committee, was a seminal member of its Cannabis Law Committee, an editor of its Bar Journal, and a chair of its Nominating and Alternative Dispute Resolution Committees. Andrew has helped shape legal policy in New York state as a member of the New York State Bar Association’s House of Delegates, and as a leading member of a committee for New York’s Ninth Judicial District and Westchester County’s Civil and Commercial Divisions where he collaborated with judges, court staff, attorneys and other stakeholders who designed and drafted the structure and rules for New York’s court mediation program. Andrew is also an approved instructor for New York State’s court certification program in advanced commercial mediation which he co-designed for judges, court staff and attorneys. Closer to his personal interests, Andrew also served as legal counsel and a member of the board of directors of RiverArts (he is a lifelong musician), and as a board member and vice-president of the Greenburgh Nature Center (he is an outdoors enthusiast).
Andrew is also a frequent presenter, including as a host of Cannabis Industry Association policy forums, and a speaker on cannabis policy at the NYS Cannabis Expo, CannaPack at the Javits Center, The Society of Marketing Professionals, The Westchester Biotech Project Forum, The Westchester County Association, The Westchester Business Council, The Westchester Municipal Officials Association and before the Sullivan County Legislature. He has been featured as an expert in cannabis law and policy in various media, including River Journal News, Honeysuckle Magazine, Chronogram Magazine, Cannabis Law Report and local cable, as well as in radio and podcast interviews.
